In April 2021, the US Consumer Product Safety Commission showed a video that displayed a child getting pulled by a peloton treadmill, falling under the arms, and getting tangled within the machine.

While he was able to recover, this does display footage that shows how dangerous the machine is for small kids.

These incidents along with over 70 more called peloton to put a recall out for the Peloton Tread + back in May.  What should you know about this, and if you live in California and are injured, how could a personal injury attorney help?

A History of Such

The CEO of Peloton John Foley created the company back in 2012, and the idea was to get people to use their bike at home even with the demanding schedules. Because of the pandemic, more people became interested, which caused a 172% rise in these products and subscriptions. However, the CPSC issued a recall, which has affected the success of the product.

The Recall

The recall was issued back in April, with over 39 different incidents and at least one death. However, the peloton reps didn’t know about the inaccurate and misleading factors that the treadmill had.  They only put on there the warning that this is only to be used by people over the age of 16. However, after the death of the 6-year-old back in May, they were finally recalled once people found out that a child died after being sucked underneath the machines.

What to do if you own one of these

If you do happen to own one of their products, you should stop using this immediately, especially if you’ve got children or pets that may sit there. they might get hurt, or even worse.

If you do use this product still, you should keep it in a separate room that children or pets don’t go into.

However, also understand that this product isn’t safe for adults either. There are people who have been injured when using this. The warning at this point extends beyond children and pets too.

There is a story of a woman who shared a very scary experience in a video when she was using the machine and a yoga ball was sucked under it. This caused the machine to stutter, throwing her off balance.

There are also reports of burns and injuries on the body too. There is also reports of the touchscreen that’s on there in that it does loosen and will eventually fall off and sometimes may do so at random.

Right now, Peloton is offering refunds up to November 6th, 2022, so if you do have this and you want a refund, then there you go.

But what about if you were hurt, or if someone you loved was hurt while using this. In the state of California, you are entitled to compensation, and in other states, you might be entitled to compensation as well.

You should be able to contact a products liability lawyer to discuss this in greater detail. They’ll look over your injury to help you determine if the claim is viable against the makers.

In some case, you may be able to file a lawsuit, but also minimally you may be part of a class-action lawsuit if you know that there is something wrong with the device as well.

The best thing to do is if you’ve been hurt by the device then call an attorney today, and get them to help you with the problems at hand, and everything else that you’re dealing with as well.
